MINUTES OF Extraordinary Council MEETING of the City of Randwick HELD ON Tuesday, 29 January 2019 AT 7:11pm

Prayer & Acknowledgement of Local Indigenous People

The Council Prayer was read by Cr Luxford. The Acknowledgement of Local Indigenous People was read by Cr Matson.

 

Apologies/Granting of Leave of Absences

 

A request for leave of absence was received from Cr Parker.

 

RESOLVED: (Shurey/Matson) that the leave of absence request received from Cr Parker be accepted and leave of absence from the meeting be granted.

 

Declarations of Pecuniary and Non-Pecuniary Interests

 

a)    Cr Parker submitted a significant non pecuniary interest declaration in Item CP1/19 prior to the meeting. Whilst Cr Parker does not perceive there to be an actual conflict of interest, to prevent the perception of an interest arising he decided not to participate in this matter.

b)   Cr Andrews declared a non-significant non pecuniary interest in Item CP1/19 as he knows a fellow Councillor who is employed by Waverley Council.

c)  Cr Da Rocha declared a non-significant non pecuniary interest in Item CP1/19 as he is employed by Waverley Council.

d)   Cr D’Souza declared a non-significant non pecuniary interest in Item CP1/19 as he may be running for the State Seat of Maroubra.

The meeting moved into closed session in order to consider the following confidential item.

 

 

CP1/19       Confidential - Sydney Football Stadium Redevelopment SSD 9835 (F2019/00118)

This matter is considered to be confidential under Section 10A(2) (g) Of the Local Government Act, as it deals with advice concerning litigation, or advice that would otherwise be privileged from production in legal proceedings on the ground of legal professional privilege.

Note: A Rescission Motion in relation to this matter was submitted by Councillors Matson, Shurey and Veitch in accordance with Council’s Code of Meeting Practice and will be considered at the Extraordinary Council meeting to be held on 5th February, 2019.

 

Note: Having previously declared an interest, Cr Parker was absent from the meeting and did not take part in the debate or voting on this matter.

 

RESOLUTION: (Said/Bowen) that Council:

 

a)       make public that part of Randwick Council’s legal advice indicating the consent of the redevelopment of the SFS is invalid in so far as it did not satisfy the EP&A Act as it failed to address the design excellence of the proposed concept and urgently call on the Minister to cease all work on the SFS site until such time as a valid DA is lodged, including the statutory notification period; and

 

b)       commence a public campaign with a cap of $5K requesting the Minister for Planning to cease any further demolition works and give proper consideration to design excellence provisions.

 

MOTION: (Said/Bowen) CARRIED UNANIMOUSLY - SEE RESOLUTION.

 

AMENDMENT: (Matson/Veitch) that Council:

 

a)       join Waverley Council in commencing a legal challenge against the development consent issued for the redevelopment of the Sydney Football Stadium; and

 

b)       commence a public campaign requesting the Minister for Planning to cease any further demolition works and give proper consideration to design excellence provisions.

 

c)       write to the leader of NSW opposition Michael Daley with a request that if Labor is elected to government at the March 23rd State election, he will authorise the NSW State Government to reimburse Randwick City Council for costs incurred in pursuing the legal challenge. LOST.

There being no further business, Her Worship the Mayor, Cr K Neilson, declared the meeting closed at 8.27pm.
