MINUTES OF Extraordinary Council Meeting of the Council of the City of Randwick HELD ON Monday, 2 July 2018 AT 6.03pm

Prayer & Acknowledgement of Local Indigenous People

The Council Prayer was read by Cr D’Souza. The Acknowledgement of Local Indigenous People was read by Cr Matson.

 

Apologies/Granting of Leave of Absences

 

Apologies were received from Crs Stavrinos and Veitch.

 

RESOLVED: (Hamilton/Matson) that the apologies received from Crs Stavrinos and Veitch be accepted and leave of absence from the meeting be granted.

 

Declarations of Pecuniary and Non-Pecuniary Interests

 

a)   Cr Bowen declared a significant non pecuniary interest in Item NR3/18 as the applicant has previously retained him in a professional capacity. Cr Bowen will be taking no part in the debate or voting on this matter.

b)   All Liberal Councillors declared a non-significant non pecuniary interest in Item NR3/18 as the speaker against this matter is a Liberal Party member.

NR3/18     Confidential - Notice of Rescission Motion Submitted by Crs Andrews, D'Souza and Da Rocha - 102-104 Brook Street, Coogee (DA/284/2015) (DA/284/2015)

This matter is considered to be confidential under Section 10A(2) (g) Of the Local Government Act, as it deals with advice concerning litigation, or advice that would otherwise be privileged from production in legal proceedings on the ground of legal professional privilege.

RESOLUTION: (Andrews/Da Rocha) that the resolution passed at the Ordinary Council meeting held on Tuesday 26 June 2018 in relation to Confidential Item CP29/18 and reading as follows:

 

(Neilson/Roberts) that Council appeal the Land & Environment Court decision relating to the proposed Dan Murphy’s store at Coogee and also seek further legal advice on grounds for appeal.”

 

BE AND IS HEREBY RESCINDED.

RESOLUTION: (Andrews/Da Rocha) that Council not proceed with a Section 56A Appeal for a Dan Murphy’s liquor store on the site of the former Randwick Rugby Club.

The meeting moved back into open session.

 

There being no further business, Her Worship the Mayor, Cr L Shurey, declared the meeting closed at 7.13pm.
