The Council Prayer was read by Cr Garcia. The Acknowledgement of Local Indigenous People was read by Cr Belleli.

 

Note: One minutes’ silence was observed for the victims of the Barcelona tragedy.

An apology was received from from Cr Smith.

Confirmation of the Minutes of the Ordinary Council Meeting held on Tuesday 25 July 2017

RESOLUTION: (Belleli/Shurey) that the Minutes of the Ordinary Council Meeting held on Tuesday 25 July 2017 and the Extraordinary Council Meeting held on Tuesday 8 August 2017 (copies of which were circulated to all Councillors) be and are hereby confirmed as a correct record of the proceedings of those meetings.

 

Declarations of Pecuniary and Non-Pecuniary Interests

 

a)     Cr Garcia declared a significant non pecuniary interest in Item GF30/17 as the Randwick Labor Club is a donor to the ALP who is him employer. Cr Garcia will not be taking part in the debate or voting on this matter.

b)     Cr Neilson declared a significant non pecuniary interest in Item GF30/17 as the Randwick Labor Club is a donor to the ALP which she is a member of. Cr Neilson will not be taking part in the debate or voting on this matter.

c)     Cr Moore declared a significant non pecuniary interest in Item GF30/17 as the Randwick Labor Club is a donor to the ALP which he is a member of. Cr Moore will not be taking part in the debate or voting on this matter.

d)     Cr Bowen declared a significant non pecuniary interest in Item GF30/17 as he was formerly a Director of the Randwick Labor Club. Cr Bowen will not be taking part in the debate or voting on this matter.

e)     Cr Andrews declared a non-significant non pecuniary interest in Item GF30/17 as he knows a number of the Directors of the Randwick Labor Club.

MM23/17  Mayoral Minute - Waiving of Fees - International Day of People with a Disability (F2017/00096)

RESOLUTION: (Mayor, Cr N D'Souza) that:

 

a)     Council vote $440.00 to cover the fees associated with hosting the Special Olympics Australia event at the Clovelly Car Park on Sunday 26 November 2017. The funds to be allocated from the 2017-18 Contingency Fund;

 

b)     Special Olympics Australia be requested to appropriately and prominently acknowledge and promote Council’s contribution to the “Soar and Roar Festival”; and

 

c)     the Mayor or the Mayor’s representative be given the opportunity to address the event on behalf of the Council.

MM24/17  Mayoral Minute - Filipino Cultural and Arts Festival - Proposed Waiving of Fees (F2017/00096)

RESOLUTION: (Mayor, Cr N D'Souza) that:

 

a)     Council votes $2,237.00 to cover the fees associated with the Filipino Cultural and Arts Festival to be held on Sunday 5 November 2017 at Alison Park, Randwick, the funds to be allocated from the 2017-18 Contingency Fund;

 

b)     the Filipino Australian Community Association, Eastern Sydney (FACAES) be requested to appropriately and prominently acknowledge and promote council’s contribution to the Filipino Cultural and Arts Festival; and

 

c)     the Mayor or the Mayor’s representative be given the opportunity to address the event on behalf of Council.

Urgent Business

 

UB8/17     Recognition of the Late John "Johno" Johnson (F2005/00266)

RESOLUTION: (Garcia/Seng) that Council:

 

(a)  recognises the public contributions of John “Johno” Johnson, a resident of Randwick City, who was a member of the NSW Legislative Council from 1976 to 2001;

 

(b)  notes that Johno was President of the NSW Legislative Council from 1978 to 1991 and the youngest member to hold the position of President;

 

(c)  notes that Johno was dedicated to the Catholic Church, a number of local parishes, and was made a ‘Knight of the Grand Cross’ of the Order of St Gregory the Great, the highest civilian papal honour;

 

(d)  notes that Johno was also dedicated to the Australian Labor Party which he served with great distinction over many years;

 

(e)  extends its condolences to Johno’s wife Pauline and his entire extended family; and

 

(f)  instructs the General Manager to bring back a report on an appropriate way to recognise Johno’s unique contribution and public service in Randwick City.

a)     approve the Draft Randwick Disability Action Plans for public exhibition for a minimum period of 28 days, and

 

b)     note that after the public exhibition period a report will be presented to Council, along with a summary of public submissions received, and proposed amendments to the Draft Randwick Disability Inclusion Action Plan for final endorsement.

a)     the Randwick City Council End of Term Report 2012-17 be received and noted;

 

b)     the General Manager be authorised to make any minor changes if required; and

 

c)     a copy of the Report be published on the Council’s website and submitted to the Chief Executive, Office of Local Government, Department of Premier and Cabinet.

CS7/17      Director City Services Report - Judge Lane, Randwick - Request for School Time Closure (F2004/07158)

RESOLUTION: (Matson/Bowen) that:

 

(a)  Council instigate an independent Road Safety Audit of the entire length of Judge Lane and a report be brought back for its consideration;

 

(b)  Council complete the proposed safety measures in Judge Lane forthwith;

 

(c)  in conjunction with this audit Council will additionally evaluate the use of further traffic slowing techniques and technology on the entire length of Judge Lane , such as more extreme speed humps, with the objective of reducing traffic speeds in the lane to the signed restriction of 10km per hour;

 

(d)  Council will seek to facilitate the forming of a School and Consultative Committee to enable direct dialogue between the school and the resident neighbours; and

 

(e)    Council urge the Director City Services to bring this matter back to Council as quickly as possible.

 

MOTION: (Moore/Stavrinos) that:

RESOLUTION: (Neilson/Moore) that Council commission a scientific study into improving the environmental value of the northern seawall at Clovelly Beach in an effort to reinvigorate the marine life in the bay.

NM56/17  Motion Pursuant to Notice - Notice of Motion from Cr Bowen - State Government taking away Planning Powers (F2017/00351)

RESOLUTION: (Bowen/Stevenson) the State government announced on 8 August 2017 the introduction of compulsory planning panels (IHAP’s) for all Metropolitan Councils, including Randwick City Council. The panel will be responsible for making all decisions on all large DA’s in Randwick with a construction cost between $5M and $30M, noting that DA’s with a construction cost in excess of $30M will be assessed by the Sydney Planning Panel. Panels will be comprised of four members, none of whom are elected or necessarily have any connection with Randwick Local area at all.

 

Accordingly this Council:

 

1. notes the introduction of a mandatory IHAP for Randwick Council is breach of the State government’s election promise to return planning powers to local communities;

 

2. notes there has been substantial community anger and distress of the state government’s planning proposals for the Randwick Local government area including Urban Activation and the recently announced Priority Precincts;

 

3. notes the introduction of IHAPS means that all large scale and high-rise development applications in Randwick will be determined or approved by an unelected State government established panel; and

 

4. calls on the State government to immediately withdraw the IHAP proposal to take planning powers away from Randwick Council.
